1. Costabeds terms & conditions These terms and conditions, together with the Legal Statement and Privacy Policy, constitute Sunway’s agreement with you for the sale of accommodation. Together, these are referred to as the 'terms'. Your booking on this website is conditional on you accepting the terms. If you do not agree with any part of them, you must not proceed with your booking. By completing your booking you accept that you have read, understood and accepted the terms. If there is any part that you do not fully understand, or if you have a query on the product, please contact Playa-Hotels. On submitting your reservation for a product on this website, Playa-Hotels will confirm your reservation by email and supply a voucher which should be printed and presented to the hotel on arrival. Playa-Hotels will not have any contract with you for the supply of any product at the price offered until your booking is confirmed and Playa-Hotels has received payment. (See PAYMENT section below). Modification of terms and conditions Playa-Hotels reserves the right to modify these terms and conditions at any time without notice and you agree that your continued use of this site will be conditional upon the terms and conditions in force at the time of your use. 2. How to book your accommodation Simply complete the details in the booking section of this website and pay the total price of your accommodation. The person who completes the web booking form must have the authority to do so on behalf of all the other travellers in the group, confirms that the people named on it accept the booking conditions, and is responsible for the full cost of the accommodation, including any cancellation or amendment charges. He/she will inform other members of the party of confirmation details and any other appropriate information. 3. Age and responsibility You warrant that you are 18 years of age or over and have legal capacity to use Playa-Hotels site and to create binding legal obligations for any liability you may incur as a result of use of this site. You warrant that all personal information submitted during accommodation bookings and membership registration is correct. You accept financial responsibility for all transactions made under your name or account. 4. What's included in your reservation The basic accommodation cost includes the following: - Accommodation and meals as confirmed on your booking - All obligatory hotel service charges and taxes - VAT on all holidays in EC countries 5. What's not included The basic accommodation cost does not include: - Transfers between airport and accommodation - Excursions and other personal expenditure - Additional charges for rooms, meals or under-occupancy in apartments - Charges that hotels or apartments may make for facilities such as cots, minibus services, sun beds, sauna tennis courts and equipment, porters etc - Deposits requested on arrival by some apartment/villa owners. 6. Payment At the time of booking the full amount will be deducted from your credit or debit card. Payment transactions to Playa-Hotels are encrypted by a secure payment system endorsed by some of the world’s leading banks. This technically secure environment ensures that credit card details cannot be intercepted and are not revealed to anyone other than to financial institutions required to process payment instructions from the customer. 7. Booking cancellation or modification You may cancel or modify your booking at any time on Playa-Hotels website. You will be advised at the time of booking what charge will apply as a cancellation fee, according to the individual hotel. Modifications involving a reduction in number of nights within the timescale that cancellation fees apply, may also be subject to this charge. Proceeding with your reservation means you expressly accept such charges. 8. Before you travel Playa-Hotels is not liable for damages or losses that may result from travel to any particular destination. The British Foreign and Commonwealth Office helps travellers stay safe overseas. Check the FCO website at http://www.fco.gov.uk/knowbeforeyougo for latest advice on conditions in and general information concerning specific countries. It is your responsibility to ensure you have the relevant visa for the country you are visiting, plus any inoculations required. Insurance You are strongly advised to travel with adequate travel insurance, as the cost of medical expenses overseas can be very high, if you suffer an accident or illness. 10. Force majeure Force majeure shall include (but is not limited to) government intervention, war or threat of war, civil commotion, fire, flood, earthquake, accident, storm, terrorist attack or industrial action affecting Playa-Hotels or its suppliers. 11. Complaints If you have a complaint you must tell the accommodation reception/management or our resort representative immediately to enable them to take action to rectify the situation. Playa-Hotels cannot be held responsible for any loss or damages caused by the acts, omissions or negligence of any third party supplier. 12. Disclaimer The information on this site is posted in good faith but Playa-Hotels cannot guarantee that it is completely free from inaccuracies and typographical errors and does not accept liability for any error or omission on this site. Links on Playa-Hotels to third party websites may exist for information purposes only. Such sites are independent from Playa-Hotels, which is not responsible for and does not endorse the material contained therein. Hotels and other suppliers of services on this site are independent businesses and not agents or employees of Playa-Hotels or its affiliates. Playa-Hotels and its affiliates are not liable for any acts, omissions, breaches or negligence of any such suppliers or any damages or expenses resulting from the aforesaid. Sunways and its affiliates are not liable for any refunds in the event of overbooking or force majeure or any other cause beyond their control. 13. Indemnification You agree to indemnify Playa-Hotels, its affiliates and suppliers and any of their respective employees and agents from and against any claims, actions, demands, fines, damages or any other legitimate costs or expenses including but not limited to legal and accounting fees brought by you or your agents in excess of the liability outlined above, or by third parties as a result of your breach of this agreement or contravention of any laws or rights of a third party, or your use of this website. 14. General These terms and conditions contain some exclusions and limitations of liability. If any part of the conditions proves to be not valid or unenforceable, the rest of the conditions will remain valid. The invalid or unenforceable condition will be deemed as supplanted by an enforceable and valid form conveying the same meaning. Any dispute will be governed by the non-exclusive law and jurisdiction of the Spanish courts. You agree that your use of this website does not imply that any partnership, joint venture, employment or agency relationship exists between you and Playa-Hotels. 15. Currency converter Currency rates are based on various publicly available sources and are not updated daily, so cannot be guaranteed as completely accurate and should be used as guidelines only. Actual rates may vary and you may wish to verify these with a qualified professional. |
